The compliance burden

Florida doesn't make it easy for volunteers.

Chapter 720 of the Florida Statutes governs HOAs. It's detailed, prescriptive, and assumes your board has the resources to comply. Most don't.

Meeting notices (720.303)

Board meetings require 48 hours' posted notice. Annual meetings require 14 days' mailed or delivered notice. Budget meetings require 14 days with a copy of the proposed budget. Miss a deadline and any action taken at that meeting can be voided.

Records access (720.303(5))

Owners have a right to inspect official records within 10 business days of a written request. The association must make records available during reasonable hours. Failure to comply can result in penalties. Your document library needs to be organized and accessible.

Violations (720.305)

Before imposing a fine or suspension, the board must provide 14 days' notice and an opportunity for a hearing before an independent committee. The process has specific requirements. Skip a step and the fine is unenforceable.

Assessments (720.3085)

Before filing a lien for unpaid assessments, the association must send a demand letter by first-class mail at least 45 days before recording the lien. The letter must include specific statutory language. This isn't optional — it's required for the lien to be valid.
